Terms of sale

Article 1 – Object

The sale of products presented on the Site (hereinafter "the Products") is reserved for natural persons who have a delivery address in the following countries: Metropolitan France, Monaco, Belgium, Luxembourg, Germany, Austria, Portugal, Netherlands, Spain (excluding Canary Islands, Ceuta and Melilla), Italy, and Switzerland. These General Terms and Conditions of Sale apply exclusively to adult natural persons who have a delivery address in one of these countries (hereinafter "you" or "the Customer"). By placing an order on the Site, you confirm that you are not legally incapacitated from doing so and are over 18 years old.

Any order on the Site is conditional upon the Customer's prior consultation and unreserved acceptance of these General Terms and Conditions of Sale. The validation of an order by the Customer, and therefore checking the box "I confirm that I have read and accept the General Terms and Conditions of Sale," constitutes acceptance of these General Terms and Conditions of Sale. JULES & JENN reserves the right to modify these General Terms and Conditions of Sale at any time and without notice by publishing a new version on the Site. The General Terms and Conditions of Sale applicable to an order are those in force at the time of the order.

 

Article 2 – Products

JULES & JENN is committed to providing the most complete and accurate description possible of the products offered for sale on the Site (hereinafter "the Products") and to ensuring that information is updated on a regular basis. However, errors may occur on the Site, which you acknowledge and accept. JULES & JENN reserves the right to modify this information at any time and without prior notice.

The Products are handcrafted with the utmost care in our partners' workshops. Given this artisanal nature and the use of natural materials, minor differences may appear between the delivered Products and the presentation photographs. Photographs and illustrations are provided for indicative purposes and are non-contractual. JULES & JENN takes particular care in ensuring the faithful representation of textures and colors; however, the actual rendering may vary depending on the display settings and resolution of the monitor used. Certain lifestyle visuals or background settings may involve digital retouching or artificial intelligence generation processes intended for the artistic staging of the collections. These processes exclusively target the environment of the Products and shall not alter the faithful representation of the core characteristics of the item (cut, finishes, appearance of materials). JULES & JENN shall not be held liable for any non-substantial differences.

The products offered for sale by JULES & JENN are those visible on the Site and are subject to stock availability. These are periodically updated. An error in updating the available stocks, whatever its origin, shall not engage JULES & JENN's liability.

In case of unavailability of a product offered for sale, you may be informed of its availability by email by providing us with your email address in the field reserved for this purpose on the product presentation page.

All orders are subject to product availability. In case of unavailability of the product(s) after placing your order, we will inform you as soon as possible by email. If you do not wish to order a replacement product, we will refund any amount collected using the same payment method used for the payment.

The Site is not intended to sell products in large quantities. Consequently, JULES & JENN reserves the right to refuse orders of more than five identical items.The prices of our products are indicated in euros, inclusive of all taxes (VAT and other applicable taxes on the day of the order), except for shipments to Overseas Departments and Regions and outside the European Union (prices indicated excluding all taxes) or unless otherwise indicated, and excluding any processing, shipping, or transport costs. All import taxes and associated processing fees are the sole responsibility of the Customer.

JULES & JENN reserves the right to modify the prices of its products at any time and without notice. However, products are invoiced to you at the price in force at the time of validation of your order.

 

Article 3 – Orders

 

The products you wish to purchase are added to your shopping cart by clicking on the corresponding icon. The shopping cart, which can be modified until the order is validated, contains the name, color and size characteristics, quantity, and price including VAT, or excluding taxes where applicable (deliveries outside Metropolitan France and outside the European Union), for each selected product. The total price indicated does not include any transport costs as these vary depending on the chosen delivery method and the country or delivery zone.

When placing your first order or subsequently, you have the option of having a customer account with JULES & JENN. You can create it by filling out the form provided for this purpose. You must enter your email address which will be your identifier and your password. If the identifier is already assigned, you will be informed. The identifier and password are personal and confidential. You are solely responsible for them and undertake to keep your password secret and not to disclose it under any pretext or for any reason whatsoever. In case of suspicion of use of your identifier and/or password by a third party, you must immediately change it and/or alert us to proceed with the closure of your account. JULES & JENN reserves the right to close any customer account in the event of unfair, fraudulent, or abusive use of the Site or non-compliance with the General Terms and Conditions of Sale. The Customer will be notified by email at the address provided when creating the account.

To validate your order, you must provide an accurate email address, billing address, and delivery address that you authorize us to save and use in compliance with our Data Protection Policy. You can identify yourself using your customer account by indicating your email address and password.

After reviewing your cart and deciding on the delivery methods for your order, you must, after reading them, confirm your understanding and acceptance without exception or reservation of these General Terms and Conditions of Sale by checking the box provided for this purpose. You will then be directed to the payment stage.

After validating your payment, you will receive an email acknowledging receipt of your order, which remains subject to our acceptance. You will be informed of the acceptance of your order by email at the time of its shipment, which is the date of conclusion of a product purchase contract between you and JULES & JENN. An invoice will be sent to you by email and will, where applicable, be available in your customer account.

JULES & JENN reserves the right not to accept or to cancel any order, even if confirmed, for any reason whatsoever, and more particularly in case of unavailability of the product(s) or difficulty concerning the received order (delivery problem, suspicion of fraud, etc.). In case of order cancellation, JULES & JENN will refund the amounts collected within the following days.

Promotional offers such as '30% off your 2nd item' are valid while stocks last, for a simultaneous purchase, and on a defined selection of products. Unless explicitly stated otherwise, these offers cannot be combined with any other current promotional codes, discount vouchers, or loyalty/referral benefits.

Article 4 – Payment

 

Validating your order implies your obligation to pay the indicated price in cash, in euros, and in a single payment.

Payment is made online according to your choice by credit card, Paypal, or by using a Digital Gift Card, the general terms and conditions of sale and use of which are specified on this page.

The accepted credit cards are Carte Bleue, Visa, Mastercard. By choosing this payment method, you will be redirected to the secure payment site of our partner Payplug, a subsidiary of the French group BPCE. The server and the payment page are secured by SSL (Secure Socket Layer) encryption. During payment, you indicate your card type, its number, its validity date, and the cryptogram on the back of your credit card. You can decide that your data be stored by Payplug for the payment of a subsequent order on the Site. Your bank details are in no case transmitted or stored by the JULES & JENN computer system.

You can proceed with the payment of your order using your Paypal account. You will be redirected to the Paypal site to identify yourself and validate the payment. Paypal never transmits your bank details to us.

Plitted payment in 3 times is available via our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure. Only purchases between €100 and €2,000 are eligible for payment with Alma. By splitting the payment in three with Alma, the Customer pays fees of 1.65% per transaction, 2.46% for payment in four installments. Alma is a remote payment manager and issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 et seq. of the Civil Code. Any termination of the General Terms and Conditions of Sale linking JULES & JENN and the Customer entails the termination of the General Terms of Use between Alma and the Customer.

 

Article 5 – Right of Withdrawal

In accordance with the provisions of Article L.221-18 of the Consumer Code, you have a statutory period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify reasons or pay a penalty. This statutory period is contractually extended to 100 days by JULES & JENN.

To assert your right of withdrawal, you must inform JULES & JENN in writing: by email (bonjour@julesjenn.com), by postal mail addressed to the company's registered office, or by completing the form provided for this purpose on the Site. You have the possibility, without this being mandatory, to use the withdrawal form proposed in Appendix I of these General Terms and Conditions of Sale.

Products must be returned unused and in their original packaging to the following address: JULES & JENN c/o CROSS LOG, 7 avenue Bernard Mions, 69780 MIONS (France). Under no circumstances should items be returned to the company's registered office. Concerning socks, the cardboard rider must not have been removed. Concerning hats, the item will not be accepted for return or exchange if it has been worn, washed, or handled inappropriately.

To benefit from free return costs to a pick-up point within our partner Chronopost's network from Metropolitan France, Belgium, Luxembourg, and Spain, you must imperatively make the request to JULES & JENN via the form provided for this purpose or by email to the following address: bonjour@julesjenn.com. The product must not have been previously exchanged. Return costs are your responsibility in other cases unless JULES & JENN agrees otherwise in writing.

In case of exercise of the right of withdrawal, and provided that the product has not been used, JULES & JENN will proceed with the refund of the amounts paid within 14 days following the notification of your request, subject to receipt of the product(s) concerned by JULES & JENN or the provision of proof of shipment of the latter. The refund will be made via the same payment method used during the order.

In accordance with the provisions of Article L.221-28 of the Consumer Code, the right of withdrawal does not apply notably to: the supply of goods manufactured according to the consumer's specifications or clearly personalized, the supply of goods that have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection. This notably concerns personalized message and gift knot options which cannot be refunded in case of return of the associated item.

 

Article 6 – Exchanges

 

You have 100 days from the date of receipt to exchange your products without having to justify reasons or pay a penalty. It is imperative that the products to be exchanged be returned unused and in their original packaging. The cardboard rider on the socks must not have been removed.

To proceed with the exchange, you must imperatively contact JULES & JENN beforehand via the form provided for this purpose, by email (bonjour@julesjenn.com), or by telephone (+33 9 77 55 75 48). JULES & JENN will then send you by email a return label to print and attach to the return package, as well as a pre-paid shipping label allowing you to drop off your package free of charge at a Chronopost network merchant or locker in Metropolitan France, Belgium, Luxembourg, and Spain. For other return methods and other destinations, JULES & JENN may send you a pre-paid label subject to the payment by you of a fixed amount which will be communicated to you upon request.

Upon receipt and inspection of the product to be exchanged, and subject to its perfect condition and stock availability, JULES & JENN will proceed with the shipment of the new item within 2 business days to the address to which the product to be exchanged was initially sent.

The free exchange is offered only once per order and only for deliveries in France, Belgium, Luxembourg, and Spain. Beyond that and for other countries, JULES & JENN will indicate the amount to be paid depending on the return and reshipment methods.

In the event that the exchange or refund cannot be made after verification of the received product, JULES & JENN may reship the product to be exchanged to you upon your payment of the preparation and reshipment costs which will be communicated to you by email.

Items must be returned unused and in their original packaging to the following address: JULES & JENN c/o CROSSLOG RHONE ALPES, 7 Avenue BERNARD VOS, 69780 MIONS (France). Under no circumstances should items be returned to the company's registered office.

Article 7 – Delivery

The processing of your order and, where applicable, its shipment from JULES & JENN's partner warehouses are carried out, except in exceptional circumstances and for pre-order items, at the latest within one business day following your validation.

In the case of items marked as pre-order, the shipping date is the one mentioned on the product page, on the order summary page, and in the order confirmation email sent at the time of payment.

Products are delivered to the delivery address indicated during the order process. No delivery can be made to hotels or P.O. boxes. Delivery will be considered to have been completed based on the information received from our transportation  partners.

Collection point deliveries are carried out by Chronopost within a time of 2 to 3 business days from the day of shipment from JULES & JENN's warehouses. You will have a period of 8 days to collect your purchases and you must bring proof of identity or the code received from Chronopost. After this period, your order will be returned to JULES & JENN's warehouses. Delivery to a Chronopost pick-up point is free in Metropolitan France starting from €25 TTC of purchase, and is charged €5 TTC below that.

Standard home deliveries in France are carried out by DPD Predict, within a period of 2 to 3 business days from the day of shipment from JULES & JENN's warehouses. Standard home delivery is free in Metropolitan France starting from €150 TTC of purchase, and is charged €7 TTC below that. In case of not being home, DPD's Predict service allows you to reschedule or modify the delivery simply via the links received by email or SMS.

Deliveries for Belgium, Luxembourg, and Spain are entrusted to Chronopost. For home deliveries, Chronopost uses DPD services for delivery to the home address. Delivery to a pick-up point is carried out within the network of Chronopost collection points and lockers. Pick-up point delivery is free for these destinations for any order over €25 TTC, and is charged €7 below that. Home delivery for these destinations is free for any order over €150 TTC, and is charged €8 TTC below that. Delivery is carried out within a period of 4 to 5 business days from the day of shipment from JULES & JENN's warehouses.

A fixed amount may be charged for standard home or pick-up point delivery for other destinations. The amount is indicated before the validation of the order depending on the chosen destination country. In case of absence upon delivery, you have a period of 10 business days to collect it from the post office or merchant that will be communicated to you by the carrier. After this period, your order will be returned to JULES & JENN's warehouses. Standard home deliveries for other destinations are entrusted to Colissimo or Chronopost.

Express home deliveries are offered during certain periods for Metropolitan France and carried out by Chronopost within a period of 1 day (excluding Sundays and public holidays) if the order was placed before noon. Express home delivery is charged €10 TTC per order (€35 TTC for Corsica).

In case of shipping delay, an email will be sent to you to inform you of any possible consequence on the indicated delivery time.

In accordance with legal provisions, in case of delivery delay, you have the option to cancel the order under the conditions and terms defined in Article L 216-2 of the Consumer Code. We will proceed with the refund of your order and, where applicable, the delivery costs under the conditions of Article L 216-3 of the Consumer Code.

Orders returned to JULES & JENN's warehouses may be reshipped at your request and expense. If, within 30 days from the date on which it was available for delivery, the order has still not been delivered to you for reasons not attributable to JULES & JENN, JULES & JENN will consider that you wish to terminate the sales contract, which will then be cancelled. As a consequence of this cancellation, we will refund the amounts paid, excluding delivery costs, within a maximum period of 14 days. The refund will preferably be made via the same payment method used during your order.

 

Article 8 – The Sponsorship Program

Sponsorship allows customers — i.e., people who have already ordered at least once on the www.julesjenn.com website — to earn vouchers by introducing the brand to their entourage. The general terms and conditions of the sponsorship program are available by clicking here.

 

Article 9 – Warranties

All products sold by JULES & JENN on the Site and delivered in France benefit from the statutory guarantee of conformity in accordance with Articles L.217-1 and seq. of the Consumer Code and the guarantee against hidden defects provided for by Articles 1641 and seq. of the Civil Code.

The statutory guarantee of conformity applies provided that the defect exists on the date of delivery and you have a period of two years from this date to act. If the lack of conformity is confirmed, you can choose between the repair or replacement of the product, subject to the provisions of Articles L.217-9 and L.217-10 of the Consumer Code.

You can decide to implement the guarantee against hidden defects within a period of two years from the discovery of the defect. If the presence of a hidden defect is confirmed and in accordance with the provisions of Article 1644 of the Civil Code, you have the choice between returning the product and being refunded or keeping the product and receiving a reduction in the sales price.

All claims, requests for repair, exchange, or refund for non-conformity or hidden defect must be made in writing via the form available on the site, by email to the following address: bonjour@julesjenn.com, or by postal mail to the company's registered office, specifying the references of the initial order and the product(s) concerned.

Prior to any return, you must imperatively contact JULES & JENN customer service (bonjour@julesjenn.com) which will send you a return label to attach to the package. Subject to the validation of a non-conformity or a hidden defect, any return costs will be reimbursed to you upon presentation of supporting documents.

For all intents and purposes, certain legal provisions are recalled in Appendix 2 of these General Terms and Conditions of Sale.

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 5 of these General Terms and Conditions of Sale.

Article 10 – Digital Gift Cards

10.1 - Definitions

The e-Gift Card refers to a digital voucher issued by JULES & JENN, redeemable exclusively on julesjenn.com as full or partial payment for an order.
The Purchaser refers to any adult individual purchasing an e-Gift Card on the website or through an authorised partner distributor.
The Recipient refers to any individual in possession of the e-Gift Card code, whether they are the purchaser or the intended beneficiary.

10.2 - Purchasing an e-Gift Card

e-Gift Cards are available for purchase directly on julesjenn.com or through the following authorised partner distributors and issuers approved by JULES & JENN: Pluxee (formerly Glady), HelloCSE and Paradigme.

JULES & JENN reserves the right to modify this list at any time. The purchase of an e-Gift Card through a partner distributor is subject to that distributor's own terms and conditions of sale with respect to the purchase transaction. These conditions apply exclusively to the use of the e-Gift Card on julesjenn.com.

JULES & JENN reserves the right to refuse or cancel any order of an abnormal nature (quantities exceeding a consumer's normal needs, unusual order flows to the same billing address, suspected fraud), including orders placed through a partner distributor.

Article 10.3 - Use of the e-Gift Card

e-Gift Cards are redeemable exclusively on julesjenn.com as full or partial payment for any products available on the website.

They are neither refundable nor exchangeable for cash, in whole or in part.
In the event of a full or partial return of an order paid for using a gift card, no refund will be issued to the original gift card. A store credit will be issued, valid on julesjenn.com, for the value of the returned items.
In the event of exercising the right of withdrawal for a purchase paid for by gift card, the refund will be made exclusively by re-crediting the gift card used at the time of payment (Article L.221-24 of the French Consumer Code).
They cannot be combined with any other promotional code, unless otherwise expressly stated on the website.
They are non-transferable for consideration and may not be resold.
If the order amount exceeds the value of the gift card, the remaining balance must be paid using one of the other payment methods accepted on the website.
If the order amount is less than the value of the gift card, the remaining balance is retained and may be used at a later date within the card's validity period.

Article 10.4 - Validity Period
An e-Gift Card purchased directly on julesjenn.com is valid for 12 months from its email delivery date. After this period, the e-Gift Card automatically expires and can no longer be used.

For e-Gift Cards issued by partner distributors (Pluxee, HelloCSE, Paradigme), the validity period is that defined by each issuer in their own terms and conditions.

Loss, theft or expiry of the e-Gift Card does not give rise to any replacement or refund. The Recipient is solely responsible for keeping their code secure.

Article 10.5 - Right of Withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to e-Gift Cards once their code has been activated or used.

However, if an e-Gift Card purchased on julesjenn.com has not yet been used, the Purchaser has 14 days from the date of purchase to exercise their right of withdrawal, in accordance with Articles L.221-18 et seq. of the French Consumer Code. In such case, JULES & JENN will process the refund within a maximum of 14 days following notification of withdrawal, via the same payment method used at the time of purchase.

Article 10.6 - Legal Warranties
e-Gift Cards benefit from the legal warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code), entitling the Purchaser to request a replacement in the event of non-conformity or defect.

Article 10.7 - Liability
JULES & JENN shall not be held liable for the fraudulent use of an e-Gift Card by an unauthorised third party. It is the Recipient's responsibility to keep their code secure.

JULES & JENN shall not be held liable for any technical malfunctions attributable to the platforms of partner distributors (Pluxee, HelloCSE, Paradigme) at the time of purchasing the e-Gift Card.

 

Article 11 – Liability

JULES & JENN undertakes to implement all means at its disposal to ensure the proper execution of the services governed by these General Terms and Conditions of Sale. However, JULES & JENN has only an obligation of means concerning access to the Site and all stages of the ordering and sales process.

The use of the Site implies knowledge and acceptance of the characteristics and limits of the internet, particularly with regard to technical performance, the risks inherent in connecting to the network and transmitting information and data, including the lack of protection of certain data against possible diversion or the risks of contamination by viruses.

JULES & JENN declines all responsibility for direct and indirect damage, whether foreseeable or not, caused during the use of the Site. Connection to the Site is under the sole responsibility of the user, who is responsible for taking all appropriate measures to protect their own data against any infringement.

JULES & JENN cannot be held responsible for damage resulting from improper use of the Products.

Unless otherwise provided by law, JULES & JENN's liability with regard to any product purchased on the Site is strictly limited to the purchase price of this product.

JULES & JENN cannot be held responsible if it is prevented from fulfilling any of its obligations due to the Customer, an unforeseen event, or a case of force majeure as understood by French Case law.

 

Article 12 – Intellectual Property

All elements of the Site are and remain the intellectual and exclusive property of JULES & JENN. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual, or sound. Any simple or hypertext link is strictly prohibited without the express written consent of JULES & JENN.

 

Article 13 – Personal Data

JULES & JENN collects personal information and data concerning you, as well as, where applicable, those of the recipient of the order. This data is notably necessary for managing your order, as well as improving the services and information we send you. It may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing, and payment. This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations.

JULES & JENN is likely to send you commercial offers by postal mail, email, SMS, telephone, or via social networks. You can object to these mailings at any time free of charge by writing to bonjour@julesjenn.com or by clicking on the "unsubscribe" link included in each email.

Every user of the Site and every JULES & JENN customer benefits, in particular, from the protection of Law No. 2004-801 of August 6, 2004, relating to the protection of individuals with regard to the processing of personal data and modifying Law No. 78-17 of January 6, 1978, relating to data processing, files and freedoms, the Law of June 21, 2017, for confidence in the Digital Economy, and the General Data Protection Regulation (GDPR: No. 2016-679).

The personal data provided is processed in an automated file placed under the responsibility of JULES & JENN and declared to the French National Commission for Informatics and Liberties (CNIL) under number 2116591 in accordance with French legislative provisions and in agreement with European regulations.

You have a right of access, rectification, and objection to the personal information and data concerning you, directly on the Site if you have created a customer account or by sending us an email to protectiondonnees@julesjenn.com or by writing to JULES & JENN, 1 rue du Conditionnement, 81200 Aussillon (France).The conditions under which JULES & JENN collects and processes personal data are presented in the Site's "Privacy Policy" document.

 

Article 14 – Agreement on Proof – Archiving

JULES & JENN archives purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the applicable legal provisions. You acknowledge and accept that the computerized data stored in JULES & JENN's recording systems are considered as proof of acceptance of these General Terms and Conditions of Sale and proof of all transactions made between you and JULES & JENN.

The data recorded by Paypal or Payplug (Stripe until 12/04/2022) constitutes proof of any financial transaction carried out between you and JULES & JENN.

 

Article 15 – Contests

Contests with weekly or monthly prize draws are regularly organised for all new newsletter subscribers on the JULES & JENN website. They are open to residents of mainland France, Belgium, Luxembourg and Spain.

The terms and conditions are specified for each individual contest.

In the case of a collection item being offered as a prize, winners are generally contacted by email to choose the pair of shoes of their choice, subject to available stock. The winning product may be exchanged if the size is not suitable, but it cannot under any circumstances be refunded.

Article 16 – Mediation

In case of a complaint not resolved amicably by JULES & JENN customer service, and in accordance with Article L612-1 of the Consumer Code, you may, within one year from your written complaint and subject to Article L.152-2 of the Consumer Code, free of charge introduce a request for amicable resolution through mediation with SAS Médiation Solution, 222 chemin de la bergerie, 01800 Saint Jean de Niost, whose website address is: https://www.sasmediationsolution-conso.fr and the contact email is: contact@sasmediationsolution-conso.fr.

In accordance with the provisions of Article 14.1 of Regulation (EU) No 524/2013 of the European Parliament and of the Council of May 21, 2013, JULES & JENN reminds that, in the event of a dispute, the Online Dispute Resolution (ODR) platform is also accessible by clicking here.

 

Article 17 – Partial Invalidity, Non-Waiver, Applicable Law, Competent Jurisdiction

If one or more stipulations of these General Terms and Conditions of Sale are held to be invalid or declared as such pursuant to a law, a regulation, or following a final decision of a competent jurisdiction, the other stipulations will retain all their force and scope.

No tolerance, inaction, or inertia on the part of JULES & JENN can be interpreted as a waiver of its rights under these General Terms and Conditions of Sale.

The language of this contract is the French language. These sales conditions are subject to French law. In case of dispute, the French courts will have sole jurisdiction. JULES & JENN undertakes, however, to seek an amicable solution before any legal action.

Art. L. 217-4 of the Consumer Code: "The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. They are also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made their responsibility by the contract or was carried out under their responsibility."

Art. L. 217-5 of the Consumer Code: "The good is in conformity with the contract: 1° If it is fit for the use usually expected of similar goods and, where applicable: – if it corresponds to the description given by the seller and possesses the qualities that the seller presented to the buyer in the form of a sample or model; – if it presents the qualities that a buyer can legitimately expect given the public declarations made by the seller, the producer or their representative, notably in advertising or labelling; 2° Or if it presents the characteristics defined by mutual agreement between the parties or is fit for any special use sought by the buyer, brought to the seller's attention and accepted by the latter."

Art. L. 217-7 of the Consumer Code: "Any lack of conformity which appears within a period of twenty-four months from the delivery of the goods is presumed to exist at the time of delivery, unless proven otherwise. For second-hand goods, this period is set at six months. The seller may counter this presumption if it is not compatible with the nature of the goods or the lack of conformity invoked."

Art. L. 217-9 of the Consumer Code: "In case of lack of conformity, the buyer chooses between repair and replacement of the goods. However, the seller may not proceed according to the buyer's choice if this choice entails a cost clearly disproportionate to the other modality, taking into account the value of the goods or the importance of the defect. The seller is then obliged to proceed, unless impossible, according to the modality not chosen by the buyer."

Art. L. 217-10 of the Consumer Code: "If repair and replacement of the goods are impossible, the buyer may return the goods and have the price refunded or keep the goods and have part of the price refunded. The same faculty is open to them: 1° If the solution requested, proposed, or agreed upon pursuant to Article L. 217-9 cannot be implemented within a period of one month following the buyer's complaint; 2° Or if this solution cannot be implemented without major inconvenience for them given the nature of the goods and the use they seek. The cancellation of the sale cannot, however, be pronounced if the lack of conformity is minor."

Art. L. 217-11 of the Consumer Code: "The application of the provisions of Articles L. 217-9 and L. 217-10 shall take place without any cost to the buyer. These same provisions do not preclude the allocation of damages."

Art. L. 217-12 of the Consumer Code: "The action resulting from the lack of conformity is time-barred after two years from the delivery of the goods."

Art. 1641 of the Civil Code: "The seller is bound by the warranty against hidden defects of the goods sold which render them unfit for the use for which they were intended, or which diminish this use to such an extent that the buyer would not have acquired them, or would have given only a lower price, had they known of them."

Art. 1648, paragraph 1 of the Civil Code: "The action resulting from redhibitory defects must be brought by the buyer within a period of two years from the discovery of the defect."
